In response to numerous requests for more information on the defunct Safe House Pilot Project that was to address the growing numbers of displaced and homeless LGBTQ youth in Kingston in 2007/8/9, a review of the relevance of the project as a solution, the possible avoidance of present issues with some of its previous residents if it were kept open.

BREXIT & LGBTQ Asylum concerns part 2: the Trumpage ........

In part one I looked at the ongoing BREXIT concerns and the outcomes from the United Kingdom’s referendum on leaving the European Union and pending referenda in Scotland to leave the United Kingdom, Ireland’s concerns about border protection and subservience to the English parliament. Business interests in both the EU and elsewhere are worried for tariffs, trade deals and future movement of investments. The immigration matters as well are of concern under an EU Schengen visa system effectively giving free movement to nationals in participating states; that may come to an end if and when ‘Article 50’ the parliamentary instrument must be enacted to start the BREXIT process. Right wingers backlash to refugees and or foreigners is alive and well for misplaced cultural fears and job availability, outside of the rowdy behaviour of some groups, namely the recent “jungle” camp in France which was destroyed by French authorities and rerouting said populations to other parts of the country even as the UK are hesitant to take persons who flow over or come by hiding in the under carriages of planes and lorries. The French have their fair share of ring wing advancement and some speculate that Francois Aunard may not win in the upcoming elections.

US EXITeering?

Said persons do not want to stay in France but will and are willing to risk life and limb to such extremes as walking the entire length of the underground tunnel from France to the UK as they see the UK a better option. A trend that has been on the rise prior to the present UK Prime Minister’s Theresa May’s tenure, the more open resistance by right wingers and pass round donkey games by some states, namely Greece lest we forget; let us also not forget Germany in last year was LGBT asylum applications and indeed others have been met with pressure from the UK’s Home Office this while some fees have increased by some 300% in some instances; that of paper applications with or without a solicitor, Prime Minister May’s expression of interest of reducing overall immigration numbers by half from some 300,000 to150,000 is a clear indication where she intends to go.

Similar postures from Holland of all places have not gone unnoticed, a recent court case in that country of a far right representative blasting Cameroonians in large numbers and they and other non white foreigners need to be reduced shows the emboldened change some have who are no longer prepared to stay in the shadows. Now that Trump has won the strangest US elections yet on anti immigration rhetoric especially to Mexicans while not defining his concern in any strident way to illegal immigrants, complete with clan support officially. He is seen as an outsider which further complicates matters, there may be a civil war inside the Republican party, will Trump come from the far right to centre left or so is yet to be seen, politics in America has been shaken and parallels can be drawn in Europe with other dynamic on the continent with a menacing China smoothing over Africa. While the Russians have been doing all they can to undermine American democracy. Isn’t it also ironic that November 9 in Germany was when that state removed the blockages for refugees?

Some of the antigay groups and pastors try to present some balance mostly hypocritically by infusing some conflict of interest in their arguments even as they celebrate Trump’s win, they claim his business interests may cloud his presidency in terms of his announced handing over of his Trump businesses to a blind trust and to his children to run, they ignore however that the law in the US says that such release of possible conflicts of interest with public officials must be done by way of said businesses by operated by some independent committee or management devoid of direct intervention by the absentee owner or management. I am not surprised said pious individuals see what they want to see as long as it suits their interests.

Unapologetic nationalism or manifest destiny?

The President elect does not recognise climate change; he is hesitant on trade deals and is looking inwards that with foreign policy. He dismisses the claim by environmentalists as alarmists, climate sceptics indeed. The Paris climate agreement and decades of legislation are in his sights for removal or severe amendments. He can start the process for now but countries cannot simply leave the protocols and agreements’, bearing in mind the main goal is to reduce green house gas emissions. He says it is ‘global warming BS’ the commitment of the countries may waiver as they were buoyed by the US leading in the charge getting the cooperation of other states, the entire agreement could fall apart. It was one of the areas with the US and China after locking horns arrived at some middle ground. Trump is also a pro-coal supporter despite China’s near about face and increasing solar energy thrust to address the pollution and smog poor air quality challenging there.

Trump might have a Republican congress to back him in certain respects but his agenda and their agenda might not be the same, it is hard to read him in terms of foreign policy, his threat to remove Obama care although that maybe really difficult, his position on pro choice and if he had changed his stance given the evangelical support and LGBTQ issues in the face of his parading of a rainbow flag at one of his stops in the campaign. Executive orders and vetoes may become the order of the day. The uncertainty troubles me much as he is unpredictable and seems to position himself as the situation requires and what of the strangeness of the Caucasian gay male support as well despite the uncertainty, who is really a Trump voter? Racists, poorer whites and Puerto Ricans moving from their island to Miami, the fundamental question in my mind; anyone can publicly find Trump’s revolting rhetoric and then in the voting booth give him the chance, despite polls, despite some media propping. Anti immigration pundits contributed greatly to Trump’s campaign as well; some locals are worried about the H2B visa work program as well, in the face of recent automation news with a patent gained on apple picking technology with harvesting rates of 1 apple per 4 seconds. Despite the fact that Americans are not interested in those types of jobs and immigrants are eager to take them, alongside nursing home care-giving ones a deceptive narrative has resurfaced to suggest said immigrants (legal or not) are ‘taking’ those jobs from Americans.

Demagogic populism has trumped sensible thinking it seems. He claimed he wants to drain the slop in Washington but he’ll have to walk through towards getting into office. A “rigged” system has got him in; wow how bizarre is that, America is seen as joke in some circles now. Trump now finds himself facing Obama after blasting him as unfit and questioning his ethnicity indeed immigration status history and citizenship but now he has to meet with elder statesman in part of the 70 days of transition to the Oval office. He has to reorder his foreign policy points during the hustings at the stomp, his recalibrations on South Korea for example are telling of uncertainty concerns. Fixed grins and diplomatic optics I suppose. The ‘Forgotten man’ reference by Trump is an old Franklyn D Roosevelt position he held, Trump says he is going to bring back jobs.

A right wing leader of Hungary has endorsed Mr Trump claiming it is time to smash misguided liberalism in his mind. The news of the Canadian immigration website crashing due to huge traffic volumes, persons seem to be exploring options to relocate and job opportunities. He flips flops literally saying or tweeting something in the morning and changing his position hours later. These uncertainties are an existential threat to small island developing states such as Jamaica. The violent anti Trump protests while highlighting the displeasure factor also seems to show up the amazing ignorance of some Americans of their own political systems and the Electoral College selection of Presidents. A popular vote does not put such presidents in the office; burning effigies of the man is one thing but did the but one can spend better time by applying pressure to the local representatives and individual state legislators so as to keep some checks and balances on Trump’s presidency and policy direction.

Some questions:

What will America’s policy on refugees and asylum seeking look like under a Trump administration; especially given the early HIV years under President Reagan and his refusal to even acknowledge the matter but siding with conservatives even more so and justifying no gays rights by stigmatized medicalizations; other under President Bush(es) there was some reticence despite USAID work to address these issues and hesitancy on asylum for homophobic victims who find it an uphill task to have their cases heard let alone win them, will there be a review of those cases that have been granted prior, will the old HIV travel ban in the late nineties or banning of donation of blood from gay men become a template for reducing asylum opportunities, will grant aid drop in a view to save money and as Trump puts develop America and create new jobs. Will Trump change Obama’s PEPFAR arrangements as well?

As Trump has threatened to bomb iSIS and other military might although at the risk of sounding ominous what should happen if he goes to war to appease his base and project strength, what will happen to successful asylum seekers, especially LGBTQ individuals, will they be forced into constriction with very little federal benefits or residency rewards, similar to what happened with Jamaicans who went to England in the second world war who joined the royal air force and allowed to apply for citizenship; or will non compliant or volunteering asylum persons be forced out by way of case reviews and examination of case files as to the status of their countries of origin, As I always said asylum status is not a guarantee to citizenship in the United States. Persons should not get complacent.

As for that acceptance speech is nice sounding and rather aspirational but despite his calmer cadence of speech obviously prepped before delivery he thrives on showmanship promoting supposed unity. I am not fooled by it as it was the divide and rule construct he used so tendentiously, as the narrative to gain support then in the speech offering an olive branch of some kind makes good for optics and smooth transitioning of power, Obama’s statesman like speech is welcoming, at least he understands the ground game and doing everything to protect his legacy.

I am still in shock that a political neophyte known as the ‘Donald’ could come to power, this was not how this election was to end even as labelled Hispanics as ‘hombre’ while playing on the dissatisfactions on certain classes “Make America great again” despite the misogyny, is democracy all but dead here now when anyone can become the leader of the free world. But John F Kennedy warned about this prior to his murder, he effectively said every President needs a lull period to adjust and settle as many of what was promised on the campaign may not be deliverable. So I conclude instead of the motto credo ‘God Bless America’ it might be read in the future as ‘God SAVE America’ instead.

There is a cultural diversity that cannot be ignored anymore, the days of the privileged Caucasian with political power are all but dead as the ‘browning’ of the US by way or Latinos, African immigrants and such is unmistakable, they will make the majority in the long run; this round seems to be a last ditch effort to hold fast to ‘white power’

Trump cannot be trusted.

Washington may change Trump or Trump may Trump Washington is yet to be seen, he may not able to ‘drain the swamp’ which is a far cry from running a private business versus governing within boundaries and Capital Hill runnings. The presidency seems to be moving to a ceremonial one than an office with on individual with raw power, said President is constrained in certain respects. Do not loose sight of the fact that Hillary Clinton got the popular vote to the tune of some 200,000 votes than Trump. The midterm elections should be interesting and when he is tested his temperament will be watched closely.


Will Michelle take it up for the next election cycle given her posturing in this last one? even as the above GQ photo of the first lady presumptive floats around. This is the image of dignity that should obtain in the Oval office?

I have to concur with former JLP spokesman (although he is antigay) that Trump is going to become the very thing he has demonised; as the reality hits him, trade deals he wants to change will be problematic and so on he will have to adjust. He cannot have his cake and eat it too.

UK Sports store suspends staff after gay couple branded ‘battymen’

So Jamaican parlance has made it to merry old UK and manifests its ugly self in an incident reported in the UK press and LGBT platforms. Thanks to Dennis Carney from Black Gay and Proud UK for alerting me to this via Twitter.

Thanks to the steady stream of vitriolic and homophobic murder music as 'art' imitates life and always changing names now internalized and cemented in the national psyche of not only Jamaicans here and abroad but now as this case shows other races who are also anti gay.

We have been called in Jamaica a list of ever changing stigmatizing terms and names such as:


Faggots

He-man

He-she

Chi chi man (TOK popularised) 

Shi-fu man (very old term mostly used in rural areas)

Battyman widely used and as popularised by Beenieman's All Battyman fi Dead and Capleton's Battyman fi get Boom or Buju Banton's Boom Bye Bye to name a few.

Sporting goods chain JD Sports has suspended a number of staff members – after a gay couple were allegedly referred to as “battymen”.

Gavin Matthews, and his partner Craig Hards say they encountered the homophobic language from staff members at JD Sports on Eltham High Street.

Mr Matthews said in a statement to PinkNews: “As I took a couple of steps in I heard from the rep behind me ‘Der battys in’it’.

“I quickly spun on my heels and stared straight at the individual who was just laughing whilst his colleague, who was no more than one foot from my side, just moved away quickly further into the store.

“My partner returned to my side and I told him in high tones ‘we’re leaving’.

“This is an outrageous homophobic hate crime and I immediately contacted JD sports customer services by email and received two days later a generic apology with a comment that they haven’t experienced this before.”

A spokesman for JD Sports has today confirmed that two members of staff have been suspended over the incident, and that one external member of staff was no longer employed by the company.

A statement to the Standard said: “Mr Matthews informed JD Sports of his complaint via the online customer service centre following the incident on Sunday 5 April.

“A new member of agency staff, who was working on a trial period at the time, unfortunately failed to properly escalate the complaint to the senior management team, who became aware of this incident on Friday 17 April. This individual is no longer working on behalf of JD Sports.

“We deplore discrimination of any kind and take this matter very seriously and took action as soon as this mistake was realised.

“Two employees from our Eltham store were suspended on Saturday 18 April pending a disciplinary hearing which is scheduled to take place later this week. The head of our customer service team spoke with Mr Matthews yesterday and he is aware of the action we are taking and will be informed of the outcome of the disciplinary process.”

EU Parliament human rights report addresses LGBTI criminalisation, trans rights and same-sex unions worldwide

Last week, the European Parliament voted its annual report on human rights in the world. The report takes account of the situation of human rights, including of LGBTI people, and makes recommendations accordingly.



The report contains strong language on the rights of LGBTI people. Particularly, the Parliament Expresses concern that “78 countries still criminalise homosexuality, including 10 which provide for the death penalty . . . and that 20 countries still criminalise transgender identities.” 

It calls to continue raising this in dialogues with third countries, and to support organisations defending LGBTI rights;

Addresses anti-propaganda laws by welcoming the annulment of the Moldovan law, and calling on other countries to follow their example;

Calls on the Commission and WHO to act towards ending listing of trans identities as mental illnesses and to introduce quick, transparent and accessible legal gender recognition procedures based on the person’s self-determination;

Highlights that sterilisation requirements for legal gender recognition should be treated and persecuted as a breach of the right to bodily integrity and of sexual and reproductive health and rights;

Encourages the EU and Member States to “reflect on the recognition of same-sex marriage or same-sex civil union as a political, social and human and civil rights issue”

A paragraph condemning referendums limiting marriage to opposite-sex couples and highlighting negative developments in Croatia, Slovakia, Macedonia, Lithuania and Russia, was watered down from the initial draft through an amendment by the centre-right European People’s Party.



Daniele Viotti MEP, Co-President of the LGBTI Intergroup, reacted: “The EU has a key role to play in promoting and protecting human rights, which includes the rights of LGBTI people. In the debate about the report High Representative Mogherini emphasised this again, saying human rights are not a priority, but the priority of external relations of the EU.”

“The adoption of this report by a wide majority sends a clear message from MEPs to step up efforts to effectively protect all LGBTI persons’ rights.”


Isabella Adinolfi MEP, Vice-President of the Intergroup on LGBTI Rights, added: “I strongly welcome this report, which confirms that LGBTI rights are human rights.”

“Now it is key to be consistent in applying this both within the EU as well as in our outside relations.”

New EU asylum rules will better protect LGBT people

The European Parliament on June 12, 2013 adopted a new version of the European Union law on asylum procedures. The text contains notable improvements for LGBT asylum-seekers.

 

The new Directive now foresees that some asylum-seekers “may be in need of special procedural guarantees due [...] to their age, gender, sexual orientation, gender identity [...]“.

When receiving an asylum application, Member States must now assess “whether the applicant is an applicant in need of special procedural guarantees” listed above.

Member States must now make sure LGBT applicants’ special needs are met, including if they are identified as such later during the asylum procedure.

Dennis de Jong MEP, Vice-President of the LGBT Intergroup, commented: “It isn’t easy to explain their story for many people who fled their country because of their sexual orientation or gender identity.”

“Sometimes they only explain the real reason for fleeing much later in the procedure, and that can lead to contradictory statements. With the new rules, this can no longer lead to a decline of the asylum application.”

The text was agreed after a four-year debate between the European Parliament and Member States.

Sylvie Guillaume MEP, Rapporteur for the Directive, explained: ”Thanks to the revised Directive adopted today, EU asylum law now includes a mechanism to identify vulnerable asylum seekers, including on the ground of their sexual orientation and gender identity.”

“This was strongly opposed by most Member States, and it’s one of our very clear achievements.”

“States will now have to identify asylum-seekers who need special procedural guarantees, determine the nature of these needs, and respond to them adequately. We will be very vigilant to the implementation of this Directive by Member States, and particularly to the effectiveness of the identification mechanism.”

These new rules will apply after they are transposed into Member States’ national laws, except for the United Kingdom and Ireland who opted out of the process. Denmark may align its law with the new rules, but is not legally obliged to.

French Gay Marriage Happenings - French President Calls For Calm

There were many celebrations in France during the evening of Tuesday 23rd April and that date will go down in history as the day that the large European country became the 14th nation in the world to legalize marriage laws for same-sex couples.

The French National Assembly in Paris passed the equal marriage bill on Tuesday afternoon with 331 MP’s voting in favour of the bill, 225 against and there were 10 abstentions. According to many, the country could see the first gay marriages taking place towards the end of June.

The new legislation also awards adoption rights for same-sex couples, is expected to be approved by the Constitutional Council and then rapidly signed into law by President Francois Hollande, who made it a manifesto pledge whilst he was trying to become president and is a keen supporter of equality.

“I hope people across the country will celebrate this moment,” marriage equality campaigner Martin Gaillard told the media.

Justice Minister Christiane Taubira told legislators on Tuesday evening the law was “very beautiful reform.”

The good news from Paris has been welcomed by many gay groups throughout Europe, Evelyne Paradis, executive director of ILGA-Europe, said: “We congratulate the French parliamentarians and the French nation for this historic step. The country whose motto is ‘Liberté, égalité, fraternité’ has finally fully applied it to all citizens when it comes to marriage.

“We also hope that this latest development in France will inspire other European countries to take concrete steps to eliminate discrimination and to ensure equal rights to same-sex partners and their families.”

“Equality cannot be partial, if a country is serious about equality for same-sex partners and their families, it means removing all legal obstacles and differences, it means equal access to marriage and adoption entitlement.”

I am delighted for my French brothers and sisters that will now have the opportunity to tie the knot in public, in front of their friends and family. It is a great step forward, not just for the gay population of France, but also for gay people all around the world. Slowly and surly marriage equality is coming to many countries and the more nations that legalize same-sex marriage the easier it will be to campaign in favour of equality. No longer can those that oppose marriage equality be able to say it will destabilise and cause the destruction of traditional marriage values, as just even a courtesy glance at the 14 nations that allow same-sex marriage, prove otherwise. Change is coming, marriage equality is coming, one nation at a time!





President Francois Hollande of France has publicly condemned the displays of homophobic violence that have occurred in the country over the recent days and weeks at an alarming rate.


“Homophobic acts, violent acts have been committed. The right to protest is recognised by our constitution and accepted by the French. But no protest must degenerate,” said President Hollande on Thursday 18th April, speaking after France’s Interior Ministry had confirmed that four people had been detained on suspicion of carrying out a vicious attack at a gay bar in Lille. The bar owner blamed the incident on the mounting “tensions” in the country over the same-sex marriage bill currently going through the French National Assembly.

There is growing concern over the levels and ferocity of an increased number of homophobic attacks and abuse in France over the last two weeks. Several anti-gay protests have turned violent in many cities across the country. A protest on Wednesday turned ugly when several thousand anti-gay protesters damaged cars, vandalised public property and attacked police officers and journalists.

Many gay activists and pro marriage equality supporters have reported threats of violence directed at them and according to gay groups monitoring the situation, reports of anti-gay and homophobic violence has gone up by a staggering and shocking 30% this year alone.

Manuel Valls, the Interior Minister is believed to have held meetings with representatives of security forces in order to “reinforce security measures surrounding protests following the excesses of the past days”. He has also verbally pledged to prevent further homophobic assaults.

French Prime Minister Jean-Marc Ayrault has also condemned the violence and has called for calm. “These protests have a right to take place, we are in a republic. But calls for violence, calls to hate, must be condemned,” he said earlier last week.

The European Parliament wants to outlaw homophobic crime and speech in the EU

Today the European Parliament adopted a non-binding resolution on strengthening the fight against racism, xenophobia and hate crime. 



The text calls on the European Commission to add homophobia and transphobia to the list of EU-sanctioned hate speech and violence.

Since a 2008 Framework Decision, the European Union foresees specific, higher penalties for racist and xenophobic speech and crime. These measures are now in force in all 27 Member States and Croatia, due to join the EU on 1st July this year.

The European Parliament has today repeated previous calls to include homophobia and transphobia in the list of grounds covered by the next version of the 2008 Framework Decision, due for review this year.

Today’s resolution was exceptionally authored by all six main political groups, who agreed that ”expressions and acts of anti-Semitism, religious intolerance, anti‑Gypsyism, homophobia and transphobia” should be punished by EU law, something the Parliament had already asked for.

The final text also calls on the Council to unblock the anti-discrimination Directive, blocked by Germany and conservative Member States for the past five years.

Raül Romeva i Rueda MEP, Vice-President of the European Parliament’s LGBT Intergroup, commented: “Lesbian, gay, bisexual and transgender people face the same type of threats, violence and crimes across the EU. Racist and xenophobic crimes deserve specific punishment, and so do homophobic and transphobic ones: they target an entire group, rather than individuals.”

Sophie in ‘t Veld MEP, also Vice-President of the LGBT Intergroup, added: “Together with the Commission, we’re waiting for the results of the largest-ever survey on LGBT people’s lives in the EU and Croatia. Once these results are published, it will be up to Viviane Reding to translate them into effective change across EU policies.”

“I’m expecting the survey’s 93,000 respondents will have underlined how much hate they face, encouraged in some countries by political and religious leaders.”

The Fundamental Rights Agency will publish the results of its LGBT survey on 17th May, the International Day Against Homophobia.

Nigerian Lawmakers move ahead on anti-gay bill ......

ABUJA (AFP) – Lawmakers moved a step closer Tuesday to approving a bill that would harshly crack down on gay rights, including banning same-sex marriage and public displays of affection between homosexual couples.

The bill which has already been approved by the Senate passed a second reading in the House of Representatives with an unanimous vote and will now see a clause-by-clause review in the chamber at an undetermined date.

“It is alien to our society and culture and it must not be imported,” House majority leader Mulikat Adeola-Akande said during debate, referring to same-sex marriage. “Religion abhors it and our culture has no place for it,” she added.

House minority leader Femi Gbajabiamila said the bill represents “convergence of both law and morality.” He said that same-sex marriage “is both illegal and immoral.”

Nigeria’s senate in November 2011 approved the bill that would make same-sex marriages punishable by up to 14 years for the couple and 10 for anyone abetting such unions.

It also set out a 10-year sentence for “any person who … directly or indirectly makes public show of same-sex amorous relationships”.

Gay organisations would also be made illegal, leading some to raise concerns over whether funding channeled through non-governmental organisations in Nigeria for AIDS treatment would be put in jeopardy.

A final House vote would come after the clause-by-clause review. President Goodluck Jonathan must sign off on the bill to give it final approval in Africa’s most populous nation and largest oil producer.

British Prime Minister David Cameron has already warned that his country will consider withholding aid from countries that do not recognise gay rights. The United States has expressed concerns over the Nigerian legislation.

Last year, US President Barack Obama ordered all government agencies that play an active foreign policy role to take steps to encourage foreign nations to put a premium on gay, lesbian, bisexual and transgender rights.

It is unclear why lawmakers have made such a ban a priority other than to gain popular support since gay marriage is not known to be prevalent in Nigeria and homosexuals are already harshly discriminated against.

Nigeria is a highly religious.



Meanwhile protests were launched in the US way back in November 2011 but it seems to no avail thus far, activists are still hitting at the moves by the Nigerian legislators there.

UN rights body hits out against violence based on sexual orientation

The United Nations Human Rights Council on June 17th 2011expressed grave concern at the violence and discrimination experienced by people because of their sexual orientation or gender identity and called for a global study to document the suffering they face.




In a resolution adopted narrowly in Geneva, the Council asked the Office of the UN High Commissioner for Human Rights (OHCHR) to carry out a study by December that details “discriminatory laws and practices and acts of violence against individuals based on their sexual orientation and gender identity, in all regions of the world.”


The resolution calls on the study to also consider “how international human rights law can be used to end violence and related human rights violations based on sexual orientation and gender identity.”


Twenty-three countries voted in favour of the resolution, 19 countries voted against, and three others abstained.


A month ago UN High Commissioner for Human Rights Navi Pillay warned that hate crimes against lesbians, gay men, bisexuals and transgender people were on the rise around the world.


Ms. Pillay stressed that homophobia and transphobia were no different to sexism, racism or xenophobia.


“But whereas these last forms of prejudice are universally condemned by governments, homophobia and transphobia are too often overlooked,” she said.


Today’s resolution notes that the Universal Declaration of Human Rights affirms that everyone is equal and entitled to the same rights and freedoms, regardless of their race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status.


The text said the Council will convene a future panel discussion based on the facts contained in the study and have “constructive, informed and transparent dialogue on the issue of discriminatory laws and practices and acts of violence against individuals based on their sexual orientation and gender identity.”

3. Decides also that the panel will also discuss the appropriate follow-up to the recommendations of the study commissioned by the High Commissioner;


4. Decides to remain seized of this priority issue.

The Society Against Sexual Orientation Discrimination (SASOD) on Government of Guyana UPR Consultations

The Society Against Sexual Orientation Discrimination (SASOD) welcomes the commitment of the Guyana government to host consultations on issues related to matters of law reform on sexual orientation and gender identity, as part of its obligations to report back to the United Nations Human Rights Council for the Universal Periodic Review (UPR) process on these and other recommendations by September 2012.

However, we are disappointed that the Cabinet Secretary, Dr. Roger Luncheon, misled the Guyanese public that the focus of these consultations is on "decriminalization of same-sex unions," as reported by Demerara Waves. The Cabinet Secretary, as well as the Presidential Advisor on Governance and the cabinet sub-committee on governance, should fully well know that same-sex unions, or "gay marriage" as one newspaper headline has already indicated, are not the subject of the state' obligations which are presently being considered under Guyana' UPR.

We are disappointed that such a high-ranking government official would misuse, whether deliberately or unwittingly, the critical politics of language to whip up public hysteria with such snide references to fearful notions of "gay marriage" Having identified itself as the facilitators of this process, the government's actions raise questions as to whether its intentions to consult are genuine, and whether it can be trusted to lead this process. We therefore recommend a more inclusive framework which includes the parliamentary opposition and can also minimize partisan positions when these reforms reach the National Assembly.
Also troubling are Dr. Luncheon's statements that, quoting Demerara Waves,

"we have the remaining months of this year to conclude the consultations, summarise what comes from these consultations and to present those findings as they are grouped and formulated as the State's policy on these three matters." SASOD would like to make its position unequivocally clear, that consultation does not mean referendum, and reiterate our stated position that the Guyana constitution is the ultimate guide on matters of citizen participation in decision-making. As Article 13 states, "the principal objective of the political system is to establish an inclusionary democracy by providing increasing opportunities for the participation of citizens and their organizations in the management and decision-making processes of the State with particular emphasis on those areas of decision- making that directly affect their well-being."

The key stakeholders of this consultative process are lesbian, gay, bisexual and transgender (LGBT) Guyanese citizens as these discriminatory laws affect our everyday lives and lived experiences. Our communities and organisations must therefore be able to manage and take centre stage in this process as these decisions affect our identities and citizenship and our views must be heavily weighted.
Guyana formally started its UPR process at the United Nations (UN) in 2010.

The UN Human Rights Council recommended that the state repeal all laws which discriminate against persons based on their sexual orientation and gender identity. These include sections 351, 352 and 353 of the Criminal Law (Offences) Act Chapter 8:01 which penalize consensual forms of intimacy between adult men in private with prison sentences ranging from two years to life imprisonment, and section 153 (1) (xlvii) of the Summary Jurisdiction (Offences) Act Chapter 8:02 which criminalises cross-dressing. After a targeted police crackdown in February 2009 where seven persons who were born biologically male were arrested for wearing female attire, four of those persons and SASOD filed a suit against the state challenging the constitutional validity of these discriminatory laws. The case is presently before the court where the Attorney General is representing the government in defence of these laws on which it now seeks to consult to determine its position.

Many are questioning locally when is our democracy going to at least have an open and honest discourse about homosexuality in general (apart from the consultations behind the scenes) and on buggery and the laws that punish consenting adults? When we see other Caribbean neighbours discussing issues far more maturely, such as school girl alleged coercion, St Lucia had a debate where homosexuality was suggested to be added as a curriculum subject in schools yet some years ago a book on our home economics curriculum that just mentioned homosexual relationships as a family unit alongside heterosexual ones nearly led to anarchy.

Let us also remember the 100 days has passed for this new administration and no sign of any look of a review as promised by Prime Minister Portia Simpson Miller save and except for one of her own in the form of Member of Parliament Damian Crawford who says it is unlikely that it will happen while poking fun at the idea of his own boss at a function, see more HERE on that including the video news clip from CVM TV.

US Anti-gay marriage group used aparteid-like race-baiting to fight marriage equality ???

So it seems based on a HRC release yesterday to include evidence of same.



Previously Confidential Documents Shed Light on (NOM) National Organization for Marriage Strategy NOM Exposed is a campaign-style operation that tracks and challenges the anti-gay National Organization for Marriage as it tries to influence elections and legislative campaigns across the US.

According to previously sealed documents obtained by The Human Rights Council HRC a human rights group defending LGBT rights in the United States an apartheid type set of strategies were said to have been planned and were to be executed by the aforementioned organization. 


HRC got a hold of internal NOM documents that shed light on the anti-LGBT movement’s overall strategy. These documents were just unsealed in Maine mid-afternoon on March 27. The docs are part of the ongoing investigation by the State of Maine into the campaign finance activities of NOM in that state. Much more to come but some high (low) lights from PDF page 13 of the “confidential” 2008-09 report to the NOM Board of Directors:

“The strategic goal of this project is to drive a wedge between gays and blacks—two key Democratic constituencies. Find, equip, energize and connect African American spokespeople for marriage, develop a media campaign around their objections to gay marriage as a civil right; provoke the gay marriage base into responding by denouncing these spokesmen and women as bigots…”

Another passage:

"The Latino vote in America is a key swing vote, and will be so even more so in the future, both because of demographic growth and inherent uncertainty: Will the process of assimilation to the dominant Anglo culture lead Hispanics to abandon traditional family values? We must interrupt this process of assimilation by making support for marriage a key badge of Latino identity - a symbol of resistance to inappropriate assimilation."

On PDF page 12, it talks about “sideswiping Obama,” painting him as a “social radical” and talking about “side issues” like pornography.



It was April 2011 where a top official at NOM had defected to support civil marriage equality and it is not the first time NOM has been accused of suspicious activity.

Sad that this is the route based on the evidence before us that opponents of gay marriage have taken to get their point across but then again it was also discovered that right wing Christian groups were financially supporting the anti gay Ugandan campaign including that infamous Bill that attempts are being made to have it pass.

Ooops! ..... Not so fast with compliments for Cuba just yet......

In the previous post we saw news of the expected passing of gay marriage and possibly other LGBT rights for Cubans, a positive step by amidst this come awful news of a murder of a member of the community there and police harrassment of native bloggers to that island. I tend to agree with a fellow blogger who also had the post title captioned in his opinion on the new developments in Cuba.

Florida-based news website Cubanet is reporting that a young transgender woman has been beaten to death in police custody in Cuba.
¨Eighteen-year-old Leidel Luis, who was known as Jessica, originally from the province of Santiago de Cuba and who lived with her partner named Yariel in Las Tunas, died after receiving a brutal beating in Guáimaro in Camaguey, southern Cuba.

It is alledged that she was picked up at a traffic stop 4 January by police calling her "faggot, nigger and disgusting."

The report is sourced to a prison inmate, Rolando Castro Sanchez who names those he alleges beat Luis to death as police officers Galindo Yarian Larena, Juan Ramon Lorenzo, their commanding officer Heriberto, and the sector chief Boris Luis Caballero. It is alleged that her body was removed after she was found dead in her cell in the middle of the night to an unknown location.

Cuba's Communist Party Congress, which opens 28 January, will reportedly adopt pro-gay provisions. Mariela Castro Espín, the daughter of Cuban President Raúl Castro and the leading advocate for LGBT rights in Cuba, wrote on her blog this week that the revision of the Family Code in 2013 will include recognition of same-sex couples.

However, continuing police harassment in Cuba, including arrests, has been reported on a number gay Cuban blogs, such as that of the Reinaldo Arenas Memorial Foundation. Gay Cuban blogger Francisco Rodríguez Cruz has also condemned 'irregularities' committed by Cuban police, who, he says, have repeatedly fined visitors to a gay meeting spot in central Havana. Sorry to hear of this tragedy. Like us in Jamaica our Cuban brothers and sisters alike have their share of drama with the authorities although same sex and transgender aesthetics are more publicly accepted than any other island in the belt here but apparently violence is still a feature as is even in more progressive or "free" states where displays of affection are normative in a sense and legislation provides protection and recourse for aggrieved persons. 

The adoption however of any pro LGBT legislation may push into over-drive the demand from the ground here in Jamaica to the promised review of the Buggery Law by the new government the People's National Party, PNP. Recently after the Prime Minister's first parliamentary address on her own mandate she said to journalists that talks are proceeding and that a timeline is not set as to when the review and subsequent conscience vote will take place, but bearing in mind the makeup of the cabinet and the all important Senate with individuals who have openly expressed anti gay views over many years one wonders if they will get pass their original positions.


Earlier in 2009 the former Prime Minister Bruce Golding had used Cuba as an example in the Charter of Rights Bill debate as one of the countries who supposedly stood up to the "avalanche" as he puts it to legalizing homosexuality bearing in mind it is not illegal in Jamaica but Buggery is (despite the gender of the recipient).

We are keeping our fingers crossed things work out and as for our blogging friends there, we have you in our prayers.

Nationwide New Network, NNN devoted some forty five minutes of prime time yesterday evening to discuss the issue and help listeners to at least begin to process some of the information coming from the most public declaration exercise as done by Jenner. Guests on the show were Dr Karen Carpenter Board Certified Clinical Sexologist and Psychologist, ‘Satiba’ from Aphrodite’s P.R.I.D.E Jamaica of which I am affiliated and Lecturer (Sociologist) and host of Every Woman on the station Georgette Crawford Williams (sister of PNP member of parliament Damian Crawford); one of the first questions thrown at Satiba by host Cliff Hughes was why has Jenna waited so long at 65 years old to make such a life changing decision?

Satiba responded that many transwomen have to hide their true identity in life .... given her life when she was younger she was a star athlete she would have been under tremendous precious to stay in from the expectations by the public and her team etc, also owing to the fact that she had a family as a man with children one may not want to upset the flow at that time until the kids are old enough. There is a lot of burden of guilt that some persons carry in weighing the decisions of coming out or transitioning so suppression of one’s true self is the modus operandi.

Dr Carpenter cautioned after a heated exchange:

“We really must remember as professionals we must stay in our lane I will never pronounce as a Sociologist cause I am not a Sociologist ............When we have an opportunity to speak publicly we must be careful of what we say unless it is extremely well informed......”

Former host of Dr Sexy Live on Nationwide radio and Sexologist tackles in a simplistic but to the point style homophobia and asks the poignant question of the age, What really are we as a nation afraid of?


It seems like homosexuality is on everyone's tongue. From articles in the newspapers to countless news stories and commentaries, it seems like everyone is talking about the gays. Since Jamaica identifies as a Christian nation, the obvious thought about homosexuality is that it is wrong but only male homosexuality seems to influence the more passionate responses. It seems we are more open to accepting lesbianism but gay men are greeted with much disapproval.

Dancehall has certainly been very clear where it stands when it comes to this issue with various songs voicing clear condemnation of this lifestyle. Currently, quite a few artistes are facing continuous protests because of their anti-gay lyrics. Even the law makers are involved in the gayness as there have been several calls for the repeal of the buggery law. Recently Parliament announced plans to review the Sexual Offences Act which, I am sure, will no doubt address homosexuality.

Jamaica has been described as a homophobic nation. The question I want to ask is: What are we afraid of? There are usually many reasons why homosexuality is such a pain in the a@. Here are some of the more popular arguments MORE HERE

Promised conscience vote was a fluke from the PNP ........



SO WE WERE DUPED EH? - the suggestion of a conscience vote on the buggery law as espoused by Prime Minister (then opposition leader) in the 2011 leadership debate preceding the last national elections was a dangling carrot for a dumb donkey to follow.

Many advocates and individuals interpreted Mrs Simpson Miller's pronouncements as a promise or a commitment to repeal or at least look at the archaic buggery law but I and a few others who spoke openly dismissed it all from day one as nothing more than hot air especially soon after in February member of parliament Damian Crawford poured cold water on the suggestion/promise and said it was not a priority as that time. and who seems to always open his mouth these days and revealing his thoughts that sometimes go against the administration's path.

I knew from then that as existed before even under the previous PM P. J. Patterson (often thought to be gay by the public) also danced around the issue as this could mean votes and loss of political power. Mrs Simpson Miller in the meantime was awarded a political consultants' democracy medal as their conference concludes in Antigua.

The agencies at the time were also highlighted and the homo negative and homophobic violence met by ordinary Jamaican same gender loving men.

The late founder of the CVC, former ED of JASL and JFLAG Dr. Robert Carr was also interviewed.

At 4:42 that MSM was still homeless to 2012 but has managed to eek out a living but being ever so cautious as his face is recognizable from the exposed party DVD, he has been slowly making his way to recovery despite the very slow pace.

When I first started blogging in late 2007 it was just as a pass time to highlight GLBTQ issues in Jamaica under then JFLAG's blogspot page but now clearly there is a need for more forumatic activity which I want to continue to play my part while raising more real life issues pertinent to us.

What to do if you are attacked (News You Can Use)


First, be calm: Do not panic; it may be very difficult to maintain composure if attacked but this is important.

Try to reason with the attacker: Establish communication with the person. This takes a lot of courage. However, a conversation may change the intention of an attacker.

Do not try anything foolish: If you know outmaneuvering the attacker is impossible, do not try it.

Do not appear to be afraid: Look the attacker in the eye and demonstrate that you are not fearful.

This may have a psychological effect on the individual.

Steps to Take When Contronted or Arrested by Police


a) Ask to see a lawyer or Duty Council

b) Only give name and address and no other information until a lawyer is present to assist

c) Try to be polite even if the scenario is tensed) Don’t do anything to aggravate the situation

e) Every complaint lodged at a police station should be filed and a receipt produced, this is not a legal requirement but an administrative one for the police to track reports

f) Never sign to a statement other than the one produced by you in the presence of the officer(s)

g) Try to capture a recording of the exchange or incident or call someone so they can hear what occurs, place on speed dial important numbers or text someone as soon as possible

h) File a civil suit if you feel your rights have been violated. When making a statement to the police have all or most of the facts and details together for e.g. "a car" vs. "the car" represents two different descriptions

j) Avoid having the police writing the statement on your behalf except incases of injuries, make sure what you want to say is recorded carefully, ask for a copy if it means that you have to return for it

What to do


a. Make a phone call: to a lawyer or relative or anyone

b. Ask to see a lawyer immediately: if you don’t have the money ask for a Duty Council

c. A Duty Council is a lawyer provided by the state

d. Talk to a lawyer before you talk to the police

e. Tell your lawyer if anyone hits you and identify who did so by name and number

f. Give no explanations excuses or stories: you can make your defense later in court based on what you and your lawyer decided

g. Ask the sub officer in charge of the station to grant bail once you are charged with an offence

h. Ask to be taken before a justice of The Peace immediately if the sub officer refuses you bail

i. Demand to be brought before a Resident Magistrate and have your lawyer ask the judge for bail

j. Ask that any property taken from you be listed and sealed in your presence

Cases of Assault:An assault is an apprehension that someone is about to hit you

The following may apply:

1) Call 119 or go to the station or the police arrives depending on the severity of the injuries

2) The report must be about the incident as it happened, once the report is admitted as evidence it becomes the basis for the trial

3) Critical evidence must be gathered as to the injuries received which may include a Doctor’s report of the injuries.

4) The description must be clearly stated; describing injuries directly and identifying them clearly, show the doctor the injuries clearly upon the visit it must be able to stand up under cross examination in court.

5) Misguided evidence threatens the credibility of the witness during a trial; avoid the questioning of the witnesses credibility, the tribunal of fact must be able to rely on the witness’s word in presenting evidence

6) The court is guided by credible evidence on which it will make it’s finding of facts

7) Bolster the credibility of a case by a report from an independent disinterested party.

VACANT AT LAST! SHOEMAKERGULLY: DISPLACED MSM/TRANS PERSONS WERE IS CLEARED DECEMBER 2014





CVM TV carried a raid and subsequent temporary blockade exercise of the Shoemaker Gully in the New Kingston district as the authorities respond to the bad eggs in the group of homeless/displaced or idling MSM/Trans persons who loiter there for years.

Question is what will happen to the population now as they struggle for a roof over their heads and food etc. The Superintendent who proposed a shelter idea (that seemingly has been ignored by JFLAG et al) was the one who led the raid/eviction.
